in fact prices are getting so high they prompted an emergency move from governor jerry brown. bob redell joins us live in cupertino. he has more on this ever-growing story in the wrong direction. bob, good morning. >> reporter: good morning to you, jon. yes, this is an emergency move that's also unprecedented. governor jerry brown has directed the california air reboersz boar resources board to allow the immediate production of the winter blend of gasoline. this should immediately increase the supply of gasoline and in theory lower the prices that you are paying at the pump. we're at the 76 station here in cupertino. this is an extreme. they're charging $5.39 for a regular gallon of gas. you can go elsewhere and find it cheaper, but it's still very expensive. here are the latest numbers from aaa overnight. an average gallon of gas in the bay area is around $4.70. if you were to look at those prices and compare them to a week ago, that's a jump of 46 to

47 cents in just seven days. now, usually california doesn't switch to this winter blend until october 31st. the downside of switching early is the blend is not as friend leto the environment. >> the winter blend of gasoline is a very similar type of gasoline that doesn't have as stringent air pollution requirements. with summer months, a cleaner version is necessary to reduce ozone when possible. winter gasoline, thanks to the cooler air, doesn't have to be quite as stringent. >> reporter: so you're wondering when these prices will drop an by how much. depends on which analyst you ask. one school of thought has prices going down 15 to 20 cents within a week. now, the reason why these prices did skyrocket is because of refinery problems. one we're very familiar with. you might recall in august when the chevron refinery in richmond got fire and in southern california over the past week, the exxonmobil refinery in torrance had a power failure and

didn't start back up until this past friday. reporting live, bob redell, "today in the bay." this morning, decision 2012 is coming to the bay area. in just a few hours the president will honor california icon before heading to san francisco for a fun raising push. president obama will be in kern county today to officially announce the establishment of the cesar chavez national monument. that property is the headquarters of the united farm workers and served as a planning and coordination center for chavez and his movement during the 1970s. afterward a dinner reception will be held for the president tonight right here. this is a live look at the bill graham civic auditorium in san francisco. john legend will perform in concert there. last night the president took the stage in los angeles at a star-studded event that included celebrities like jon bon jovi, stevie wonder and katy perry.

the president marvelled at their performances an even took a shot at his own debate performance. >> these guys and everybody here is incredible professionals, they're such great friends and they just perform flawlessly night after night. i can't always say the same. >> as for mitt romney, the republican nominee is set to take aim at the president's leadership and foreign policy at the virginia military institute this morning where he is. coming up at 6:30, we will have live team coverage on both sides of the campaign trail, including specifics on mitt romney's plan to crack down on egypt and that crisis in syria. moving to a developing story in hercules. friends and family holding a vigil for a hercules woman found dead inside of her home over the weekend as police try to track down the person or persons who killed her. neighbors placing flowers and notes outside susie ko's home this weekend.

police say somebody killed ko friday night. her husband was working at the time in idaho. ko's children simply devastated. >> very shocking. i found out first thing saturday morning. she had passed friday, but my phone had died. as soon as i turned it off, i got a call from my sister, i found out and just hurried home. >> as part of this investigation police removed the front door of that home as evidence and they say ko's car is also missing. police right now looking for a 2011 sky blue subaru outback. idaho license plates number 1a1f680. ko's family is planning a vigil tonight at 8:30 outside of their home. they have also set up a website welovesusieko.com to try to help

spread awareness about this case. san francisco police are still searching for a pair of car thieves who allegely tried to run down a u.s. park officer. this happened this weekend on lincoln boulevard in the presidio. investigators say a u.s. park officer spotted one of the men breaking into a parked car. the man jumped into a car that was waiting nearby and his accomplice allegedly tried to run down the officer. he missed and the park officer opened fire. the men were last seen in a light tan buick sedan. a north bay narcotics investigator is now suspected of actually doing drugs himself. 35-year-old j.j. onjade worked for the major crimes task kroers while working for the novato police department. the allegations could impact a murder case that he investigated. in fact the allegations have delayed sentencing for the four men convicted of killing a liquor store owner back in 2008. lawyers for these men could use

these new allegations against onjade to request a new trial. happening now, a major commute route in the east bay is still tied up after a deadly crash. lafayette police are still investigating what happened near pleasant hill and springhill roads. officers say the driver hit a tree and a utility pole yesterday after allegedly driving recklessly. southbound pleasant hill road will be closed this morning between springhill road and stanley boulevard. both will reopen once that tree is cut down and that pole is replaced. 6:07 right now. we still have another cool start to the week but christina loren says lots of things in store. it's going to get warmer, rain, all sorts of things. >> we've got a very interesting forecast. we want to start with a live picture this morning over downtown san jose. just spectacular here. you can see those lights clearly. once that sun starts to come up over the course of the next 45 minutes, we are going to get spoiled with a gorgeous sunrise. so we do have some shower on the

rare, mostly up north, in the north bay and down to san francisco. the next 48 hours we'll keep that rain chance at 20% to 30% overall for the whole bay area. so 54 in stinson beach this morning, 53 in san mateo. you can see here mostly clear conditions right now. you can vividly see the moon and the stars. 70 degrees inlane, 72 at 4:00 p.m. and 65 at the coast so not a whole lot of separation in terms of your inland temperatures versus those at the coast. fall has finally arrived. let's take a look at your drive, mike. >> we're looking at 101 northbound on the right side. that's the way it should go, northbound on the northbound lanes. but on the maps we show you someone is going northbound in the southbound lanes just for a very short period. it sounds like they realized and pulled over. there's a car on the side of the row. there's activity there but no

two scientists responsible for a stem cell break through have won the nobel prize for medicine this year, shinnia yaum kno -- shinya yamanaka and john gurdon. it is the first nobel prize to be announced this year. the physics award will be announced tuesday, tomorrow. chemistry will be announced wednesday. literature on thursday and then the nobel peace prize on friday. >> brilliant minds at work, love it. it is 6:12. if you're just waking up with us, we want to give you a quick check on the top stories. governor jerry brown signing an emergency order to try to deal with all the rising gas prices.

this will make winter blend gasoline available three weeks ahead of schedule. the cheaper gas is less environmentally friendly but should increase the supply enough to hopefully bring those prices down. president obama is in san francisco today for a quick appearance and fund-raiser. he'll be at the bill graham civic auditorium for a dinner and concert tonight. the event is sold out with the most expensive tickets selling for $7500. an a vigil will be held tonight in hercules for a woman who was found dead inside her home friday. police say susie ko was killed by blunt force trauma. the family car was also stolen. family and friends will be gathering outside of the home tonight starting at 8:30 for a candlelight vigil. moving on now to business and tech, foxconn factories are denying reports its workers are on strike. >> there's talk workers just walked off the job when they were making those iphones. >> yes, good morning. hard to know what's accurate because we in the media have so little access to what's going on

behind those fakary walls. there were reports of strikes after chinese workers were told to take more care making your iphone. some americans report their iphones have been scratched brand new out of the box and these strikes reportedly came as factory managers increased quality inspections. the u.s. congress this morning is issuing its strongest warning ever that america's security is at risk from some chinese electronics. the house intelligence committee will issue findings from a year-long investigation that say chinese companies waway and zte are threats to national security. waway has officers in santa clara. the fear is the electronic equipment made by these companies, which are backed by the chinese government, can be used to spy on the united states. the equipment is used in telephone networks, cell phone towers, internet server farms and other communications.

in a separate but related bit of news, cisco accusing zte of reselling cisco equipment to the i rain janua iranians in violation of u.s. law. while the house committee on intelligence does not have the power to ban chinese communications equipment, the warning that no one, not the government, not the military, verizon, comcast, at&t should be buying equipment from waway and zte should be a big business opportunity for cisco. not your average target store. san francisco is waiting for its first target to open at the metreon on sunday. when it does shoppers will notice it's a little different than the others. the so-called city target will open one hour earlier than other stores at 7:00 a.m. it features smaller than average shopping carts and a special

eating area overlooking yerba buena gardens. another city target opens this week in los angeles. by the way, plans for a second target in san francisco, already in the works. >> of course target has a little of everything, including starbucks. speaking of starbucks, the company is letting san francisco become the official taste tester of a brand new food line. the coffee chain assessing out some new croissants, muffins, loafs and cakes with plans to eventually roll them out nationally. the new baked goods stem from starbucks $100 million purchase of a small san francisco bakery chain, and they do have some tasty treats. hopefully that good news from starbucks will soften the blow of this news. starbucks reporting a shortage of pumpkin spice for its popular autumn lattes. people devastated coast to coast. starbucks says some can't keep up with the demand due to the infrequent deliveries of the

special sauce to make the drink. the shortage is not affecting all stores nationwide, just some of them. i can tell my co-host, marla tellez, is crushed. >> honest to god that's my favorite latte, the pumpkin spice. so good. morning dessert. >> moving on. she'll be okay hopefully and the weather will get a little nicer as we move along the week. >> it's certainly getting cooler as you wake up in the mornings. yeah, that coffee comes in a little bit more clutch this time of year. temperatures are going to be beautiful today and what's going to be even more beautiful is the sunrise that we are expecting. 7:11 a.m. the sun officially rises. between the hours of 6 cln 45 and 7:00 you'll get some spectacular reds and oranges. some light showers coming down in san francisco. south of san mateo, good morning to you, 6:17 now. as you're making your way out from front door, you want to prepare the kids for a slight chance of showers especially

along the peninsula north of san mateo. there's an area of low pressure that's been sitting and rotating offshore. it's been mixing up our atmosphere and that's why we haven't had a lot of fog the last couple of days. you can see this, we get a little rain band that comes through. best chance for showers today will be between 8:00 and noon so keep that in mine. after which we'll clear out nicely. we stop that clock when we meet back here tomorrow morning, mike and i will be busy with shower on the way. the first significant rainfall of the season so far headed our way on tuesday, so we've got a better chance tomorrow. mix of sun an clouds today and temperatures will be comfortable. 65 in san francisco, 70 in los gatos and 70 in santa teresa. the next three days just get even more comfortable in terms of temperatures. we're only going to break into the 70s but there's a warmup on the day. if you've been craving beach day, they have not yet come to a close. you can hit the beach in the second half of your weekend in particular. monday, tuesday and wednesday

i'll have to use those 90s, i do believe. everything is leading me to believe it's going to be very, very warm. the model is bringing in a very strong high pressure. i had people tweet, mike, that they were surprised at how quickly they were able to maneuver around the city because everybody took mass transit. >> that's good news. we saw how many people took mass transit setting those records on b.a.r.t., so thank you all for playing that home game as well. that helped out. we are looking over here getting from home to work and we have your typical build west 580. no surprises, but it is there. the slowing through livermore and heading toward that dublin interchange. we'll give you a look farther south and look at fremont 880. now, this is the truck scales just around tesla. but this new light-up sign they put in, they lit it up and it may be a little distraction, enough to cause some additional slowing the next few days as folks get used to that before sunrise. after sunrise not a big dole. look over here to the south bay

and we'll look at the traffic flow for the northbound routes. 880 and 101 scattered incidents off of the roadway. stevens creek still two lanes block. slowing for 101 starting to kick off the volume for south 880 but speeds still about 60 there. up the peninsula, we do have an accident over at willow. we have another accident reported here and a fire truck blocking part of the off-ramp but the off-ramp is still open. and the bay bridge toll plaza, the backup in the cash lanes and we expect those metering lights to be on any second now. easy drive, though, east shore freeway. it is 6:20. it is do or die for the area's baseball teams. tomorrow the giants will take the field in cincinnati knowing it could be their final game of the season. they were beat by the reds last night losing 9-0. they now trail in the best of five series 2-0. ryan vogelsong will take the mound tomorrow. game time is 2:37. as for the a's it was also a rough weekend.

they're in the exact same position as the giants, must win. they lost two games in detroit over the weekend and now trail that best of five series 2-0. they have to win three straight to advance. tomorrow's game starts at precisely 6:07. no doubt the hometown a's crowd not happy about this controversial play. look at that, kissing the ball in the ninth inning. al albuquerque fields the ball and literally kisses it as he fires over for the out. that one is not against the rules but definitely tacky, in bad taste, and he will probably get some much-needed payback. >> bad sportsmanship. 6:21. coming up, heavyweights in half moon bay. the halloween tradition that could bust a world record just ahead. >> look forward to that. oh, i know he wasn't looking forward to this. the moment of impact. an out of control crash leaves a convenience store clerk pinned right behind that counter. alright let's break it down.

welcome back, everybody. giving you a live look at hp pavilion, the home of the sharks. let's hope that that lockout ends so we can start the season. it was supposed to start this week. we will continue to stay on this story. it is six:24. the winter olympics still a couple of years off but the olympic torch taking the long road in russia. organizers say the relay route will measure, get this, more than 40,000 miles as it weaves

visible with those flashing lights. in lanes are reported blocked. 280 is just fine as well as el camino. and the bay bridge, you have the backup and the metering lights are now on. all lane showing slowdowns from the 880 overcrossing all the way to the metering lights. the span is clear. back to you. it is 6:26. i think calling today a big day for pumpkin growers would be a big understatement. >> half moon bay's annual pumpkin weigh-off gets started today. this is a video of last year's winner which broke the state record weighing in the an 1,704 pounds. here's a look at some of this year's contenders. growers had extra incentive to go above and beyond the record this year. safeway is offering a $25,000 prize to the world's first one-ton pumpkin. that's 2,000 pounds. even if no one breaks that mark there are heft tee prices for first through tenth place. winners will be on display this weekend at half moon bay's pumpkin festival. that means that highway 92 is

how a grief-stricken community is coping and why the driver isn't behind bars. and there it is, live at the new york stock exchange. we take you to wall street for the bell ringing in the markets. we'll take a look at what's happening there on this monday, october 8th. this is "today in the bay." it is 6:30. good morning, everybody. happy columbus day. i'm jon kelley. >> and i'm marla tellez in for laura garcia-cannon. we begin with decision 2012 and the race for the white house. this morning the bay area is one of the big stops on the campaign trail as air force one prepares to touch down on the peninsula. the visit comes as mitt romney prepares to call out the president as a weak leader during one of his most important speeches this year. we do have a team in place to cover this big day in politics. tracie potts is live on capitol hill, but we do begin with christie smith live outside the

bill graham civic auditorium in san francisco with a look at the president's big fund-raiser there. good morning, christie. >> reporter: good morning to you, marla. you know tickets started at $100 and went all the way up to $7500. with that you would get a picture with the president, but they're all sold out. and guests are being asked to arrive as early as 5:30 this evening, even though president obama isn't scheduled to speak until around 9:40 this evening at the bill graham civic auditorium. the metal barricades are stacked up out here this morning. if you don't want to get caught in it, certainly avoid the area near city hall. president obama is coming to the bay area from los angeles, part of a two-day swing through the state as the campaign enters its final weeks. the president and challenger mitt romney looking to raise money to compete in competitive states like ohio. in los angeles, president obama poked fun at his own lackluster debate performance but also brought in the big bucks.

$3.75 million at one event. of course he had help with celebrities like george clooney and jon bon jovi. before even hitting the bay area, though, he'll be near bakersfield today to announce the new cesar chavez national monument. of course he was the founder of the united farm workers union. today in san francisco president obama arrives at sfo at 1:40 this afternoon. then he heads to an event at the intercontinental hotel at 4:00. at 5:00 there will be a dipp ed and reception that starts at the civic auditorium with john legend performing. also alex smith expected to a10. next from here president obama spends the night and then heads to ohio. reporter tracie potts joins us live from washington, d.c., with more on what challenger mitt romney is up to today. >> reporter: thanks, christie. while the president is out there in the bay area raising funds

and trying to get votes, mitt romney is going to be here -- actually in virginia on the east coast focusing on foreign policy, an area where he has not polled as strong as the president. now with this bounce coming out of the last debate, he is hoping to build on that. today at virginia military institute he's going to talk about all the hot spots in the middle east, syria, libya, egypt. a strong military with no defense cuts. the president has criticized him for giving the pentagon more than they have asked for. he's also going to talk about israel as an ally. specifically on libya he will say this was the deliberate work of terrorists, the four americans who were killed there. al qaeda, the same people who were behind 9/11. he will urge arming the rebels in syria and he'll say the billion dollars we give egypt every year in aid should be tied to them keeping their peace treaty with israel. democrats already fighting pack on what mitt romney will say.

coming up today, the white house called him an unmitigated disaster on foreign policy. and the obama campaign says when he talked about americans being killed in libya and made it a political issue, as they put it it was not only cynical but also offensive. we wait to hear what he'll have to say today. live from washington, i'm tracie potts, "today in the bay." >> thank you very much. we can tell you charges have not yet been filed against a driver who struck and killed a little girl in a church parking lot. the 6-year-old girl was walking with her mother to a religious school in daly city saturday when they were hit by that car. another woman was also hit and pinned right to the ground. the girl's mother and that woman are still in the hospital. the church is bringing in grief counselors to help children who were friends and knew the little girl. daly city police say the crash remains under investigation. oakland police are still trying to sort out a shocking discovery in the eastmont neighborhood.

a decomposing body was found yesterday inside a parked car near a recreation center. it was wrapped in a cloth and left there for some time. police have not identified the body and have yet to give details on the cause of death. it is 6:35 right now. in names just yet but police are putting a face to the suspect in a burglary investigation in palo alto. palo alto police releasing a color sketch of a man seen speeding away from that scene of a home burglary on arrowheadway last thursday. investigators say the man went through a side yard gate and then climbed into a home through an open bathroom window. several items, including a tablet computer and video game console were stolen. officers say the man was able to get away driving a black four-door bmw sedan. it was certainly a nice weekend all over the bay area. let's check the forecast with christina loren. a little bit of a change coming. >> starting to feel more like fall around here.

i want to start with this live picture, beautiful conditions. we are going to get a phenomenal sunrise. the official time 7:11, just like the quickie mart. now taking you to san jose. the yellows and oranges starting to arrive and we're going to have a beautiful day today as a result. also dealing with some showers from san francisco down to daly city, even san mateo. getting a little bit of isolated activity. that will ramp up between now and 9:00 a.m. between 9:00 and none we'll start to see that system push right back out to sea. so for us we've got an interesting forecast the next 48 hours. we stop that clock at 5:00 p.m. tonight. showers stay offshore basically all night long and then they return quickly just in time for the morning commute tomorrow. have no fear, mike and i will be here to guide you through it. 70 inland, 70 bayside and 65 at the coast. mike, i tip my hat to you for getting everybody to take mass transit this weekend. it was light in san francisco at

times. >> likewise to you, christina, because everyone was prepared with what to wear. good stuff. we're looking over here and the morning commute is on. this is palo alto, northbound 101 with the headlights past university. a smooth drive here. the southbound side okay at university but the map shows you still slow approaching whipple. there was a fire crew on scene for a short time. there were minor injuries after a secondary accident. things are sorting out now. south 101 approaching whipple and south 280 through the same area looks like some folks are trying to avoid the area but this should clear up in the next few. the san mateo bridge westbound with the taillights away from the toll plaza heading over to the peninsula where we just showed you. a smooth drive for 92 but the westbound commute already starting to show that build. we'll see a slow drive across the san mateo bridge this morning. the bay bridge, of course we have the backup at the toll plaza. no problems for the east shore freeway or off of the maze, it's just right as you pass by west grand avenue that you see the slowdown to the metering light. 6:37.

well, we have new video to show you this morning of a speeding truck crashing right through the wall of a sacramento area liquor store. surveillance video catches this as the truck plows right into the cash register that pins the store owner right behind the counter. he was just there helping a customer. that driver immediately pulled out of the store and then drove off in his truck. police were able toatch up with him a short time later. he was arrested for dui. the store clerk was taken to the hospital and is expected to be okay. bride wars come to life of the an argument at a wedding turns into an all-out brawl in philadelphia. >> did they just deck the bride? >> a 15-year-old recorded this on his cell phone. it happened at a high-end hotel where two weddings were being held. police say the fight originally started within one wedding party. the other wedding party got involved when someone was reportedly hit with something. several people were hurt.

new details in the deadly shooting of a border patrol agent. the border patrol council says the agent killed last week in southern arizona apparently opened fire on two fellow agents, thinking they were drug smugglers. that agent was killed when they returned fire. the two sets of agents approached an area where a sensor had gone off early tuesday from two different directions. the border patrol is not commenting on who fired the first shot. the fbi is investigating this case. new this morning, joran van der sloot who is in prison in pe ru is about to become a father. this is one of the strangest stories you will hear. they say he impregnated a woman during an unsupervised visit while in lima. he is serving a 28 year sentence.

that woman is past her third month of pregnancy and van der sloot confirm that to dutch newspapers. lawyers for jerry sandusky are speaking out as a judge prepares to hand down a sentence. tomorrow jerry sandusky will learn how long he will spend behind bars, but today prosecution and defense teams will meet at a presentencing hearing. sandusky is likely to spend the rest of his life at a state prison. the 68-year-old's attorney admits his client made mistakes but he said he iinnocent of all charges. >> whether he's guilty or not, and a lot of them said, look, the evidence is overwhelming but we believe in our system and we don't believe the system is fair to jerry sandusky because it was obvious that you weren't ready, you were still doing investigative work and we don't understand why they did that. >> sandusky was convicted on 45 counts of child abuse for molesting almost a dozen boys. happening right now,

commuters getting ready to drive to work today, you may get a rude awakening if you stop to fill up your gas tank. all those high gas prices we saw on friday got even uglier other the weekend. we found a station in menlo park where gas is more than five bucks a gallon for regular and it gets worse. this is a sight that's becoming more common but we're being told help is on the way thanks to an order signed this weekend by governor jerry brown. bob redell join us live from cupertino with a move that could help hopefully bring prices back down. bob, good morning. >> reporter: good morning to you, jon. a move that is an emergency move and an unprecedented move. governor jerry brown has ordered the california air resources board to immediately allow the production of the winter blend of gas, which should immediately increase the supply of gasoline out there and in theory bring these prices down. now, this is an anomaly right here. you're almost at $5.40 for a

regular gallon of gas at this 76 station here in cupertino. you can find gas much cheaper but it is still very expensive. how expensive? look at the latest numbers from overnight courtesy of aaa. in san francisco a gallon of gas is averaging $4.73, oakland and san jose both $4.67. those represent a jump of 46 to 47 cents over just the past seven days. >> oh, my god, it's just going up. it's hard to afford. and i'm not working, so i'm looking for the cheapest gas. >> i try to get it where i can get it the most cheapest. right now this is the area to come. >> worth the wait? >> i can say it is. >> reporter: california usually doesn't switch to the winter blend until october 31st. the downside of going early, this blend is not as friendly to the environment since it does evaporate quicker in warmer weather. no one is saying that the switch is going to be a magic wand, so to speak, to bring these prices

down. one school of thought has us seeing a drop of maybe 15 to 20 cents per gallon over the next week, which would still be well over $4. the reason why we've seen these skyrocketing prices according to analysts. one reason, we saw the refinery fire at the chevron refinery in richmond. that was in august. there was another refinery problem, a power failure shut down a refinery at the exxonmobil refinery in torrance in southern california and they didn't resume production until this last friday. bob redell, "today in the bay." we're talking just a slight chance of showers. >> yeah. i think we're going to see some. i bet my bottom dollar on it. good morning to you. that's how i make my living. i'll show you exactly when coming up but she has a good point. we're not going to see a good lot of it and we're only expecting one certain part of the bay area to get hit. i want to start with this live picture. clear skies overnight making for a very cold morning. we're close to the upper 30s up

african-american lieutenant governor has died. mervyn dimaly tied after months of declining health. he began his political career in 1962 and became the first black senator in 1966. after serving as the first and only african-american lieutenant governor, he went on to serve in congress for more than a decade. he is survived by his wife and two children. he was 86 years old. now to decision 2012. this morning republican presidential nominee mitt romney tackling foreign policy during a speech at the virginia military institute. romney will be playing out his proposal for the u.s. to take a more assertive role over in syria. he will also outline stricter conditions for aid for egypt and tighten sanctions in iran. now, experts say romney is using that speech to paint president obama as a weak leader who has limited americans' influence on

smashed windows and threw paint at oakland's city hall overnight. almost 200 protesters smashed windows and threw paint at half a dozen buildings. the demonstration was to coincide with the 11th anniversary of the war in afghanistan. there were no arrests or injuries. a group of protesters was arrested in san francisco saturday afternoon and it may be connected to last month's vandalism of a police station in the mission district. we have cell phone video to show police in riot gear lining up trying to stop protesters near california and battery streets. protesters marching through the area saturday vandalizing cars and businesses. at least 20 people were arrested. last month the mission district police station was vandalized by demonstrations. demonstrators upset over a shooting that involved a police officer. police believe some of those protesters arrested this weekend are connected as well to that incident. jon stewart and bill o'reilly debated each other on a
